This issue of the Litigation Management Report focuses
on innovation. My sense is that insurers are looking to litigation
managers to be innovative. They want to hear about new ideas
and, more importantly, strategies for implementing them with
some examples of new ways of doing things that are adding
value to the mix.
I use the lead Litigation Management Strategy article,
Innovation, to lay the groundwork on innovation. I explain
what being innovative means and how to become innovative.
What I want to bring to your attention most of all in this
article is the distinction between operational excellence
and innovation. It 's the dividing line between incremental
improvement and breakthrough results.
The Bill Management article, Making an Impact,
provides litigation managers with critical information on
how to get that all-important attention from the executive
team for innovative ideas you do have and the support to actually
implement them. It should be read in conjunction with the
book review in the Ideas section of the newsletter.
In fact, I would recommend that you read the review of Art
Kleiner's book, Who Really Matters, prior to reading
the Bill Management article. Kleiner is an iconoclast
and among the better-known of the contrarians who challenge
popular strategies like the balanced scorecard and six sigma.
According to Kleiner, the success of all of these objective
change management methodologies, although not necessarily
wrong, are dependent on who you know in the organization and
your ability to influence their thinking. It is the politics,
not the theory and principles, that are key to change management.
It is only fair after spouting off about innovation that I
provide insight into an example of breakthrough thinking.

Formal Opinion 03 - 430 - Propriety of Insurance Staff
Counsel provides an outline of permissible parameters
for a breakthrough strategy for insurers. I will provide more
details on Staff Counsel in the next issue, but the formal
opinion is a good starting point.
