Editor’s Note:

Consider the Leading the Performance Management Initiative in the Litigation Management Strategy section of this issue as a continuation of the points made in the previous issue. It is important for litigation managers to appreciate that there needs to be a technology/strategic management match for successful execution of a performance management initiative. My John G. Kelly Report will bring you up to speed on the latest buzz that has taken place at the usual batch of conferences that deal with litigation management issues in corporate legal departments. You will note that, overall, insurance litigation managers are 1-2 years ahead of corporate legal departments on a matters pertaining to bill review. On the other hand, many insurers are in the early stages of implementing convergence programs. All of the conference sessions on convergence have only good things to say about it, which provides you with confirmation that you are on the right track. The title the Ideas book review, Hard Facts Dangerous Half Truths & Total Nonsense speaks for itself about the subject matter. It is a great book for confirming that many of the doubts you have had and probably still have about the rationale for strategic decisions are probably correct. However, I have put this book on the recommended read list for litigation managers more for the solid advice it provides on how to make decisions based on solid evidence rather than canon fodder for negative thinking. That supports the mission of the Litigation Management Report and the direction in which litigation managers need to keep moving.

Assuming a leadership role in performance management is not about leading a charge and taking no prisoners in a drive to get control of the litigation management program. Hard Facts Dangerous Half Truths & Total Nonsense

Although we live in a knowledge-driven economy, many of the decisions we make and actions we take are driven by at best half-truths and more often than not by total nonsense. One of the perverse side effects of this is that we do have hard facts to demonstrate how embarrassingly accurate that assertion is.
