2005 - February Issue #12

The John G. Kelly Editorial Comment:

The Litigation Management Report is a strategic electronic information provider. Welcome to the next generation of that strategy with the introduction of what will become a series of case studies on litigation management. The case studies will enable litigation managers to get a first hand look at how their colleagues are executing strategic initiatives. If you want to be part of this exciting process and reach out and share success stories with colleagues with a case study, not to mention raising your profile within your own company, just send me a quick e-mail. I will show how I can do all the leg-work in pulling a case study together for you. The John G. Kelly Report feature will expand its scope by incorporating reports on major conferences and symposia into its timely updates. Ideas will continue to do what it has been doing a terrific job at since its introduction last year: prodding litigation managers to think outside the envelope.

The Utica National Performance Measurement Case Study is the inaugural case study in the Litigation Management Report. It is an excellent validation of what you will read in my report on Legal Tech New York. A corporate counsel panel session highlighted Scorecarding as the emerging strategic initiative of major importance to the corporate legal department community. The Utica National Case Study illustrates the degree to which insurance defense is on the leading edge of that curve. Read what they have done and follow that lead.

The John G. Kelly Report does more than just write about a conference. It actually explains how to get maximum value from one of the most important annual conferences held for the legal profession. Legal Tech New York is to the legal profession what the Detroit automotive show is to the automotive world. This is where major new technology concepts are floated out to the market place for expressions of interest and leading edge technology is launched. The event can be overwhelming for first-time and repeat attendees. You will find my report on how to take in this awesome event without being overwhelmed informative. If you have not been, I hope it encourages you to attend next year.

Ideas in this issue will take you way outside the envelope. Sometimes it is necessary to think about the larger world in which we live and what we might or might not be making of it for ourselves, our family and those destined to follow in our footsteps. Collapse, by Pulitzer Prize-winning author Jared Diamond, is more than just another best-seller of the month. This is being widely reviewed as a seminal work that provides us with a stark message and blueprint for our future well-being. I have said enough to pique your interest. Just make sure you incorporate it into a period of your reading time when you have the opportunity to reflect and think about big picture things for a few moments.

Enjoy the new generation of the Litigation Management Report.

The solution to the [over billing] problem (by insurance defense lawyers) is not billing guidelines and audits, but instead is the retention of trustworthy and honest lawyers by trustworthy and honest insurance claims handlers.... click here to learn more

Legal Tech New York 2005

You have to experience Legal Tech New York at least once. It is a right of passage for everyone in legal services management. Start with an exhibit center filled chock-a-block with 250 + vendors and consultants and you get the picture. On my second day leaving the hotel for the plenary session I happened to share the elevator with two legal professionals from Japan who were so overwhelmed by the size of the event that they were going to go AWOL, at least for the morning, just to catch their breath. What follows is your editor's first hand report on "how to do Legal Tech."… click here to learn more

How Societies Choose to Fail or Succeed
Jared Diamond
Viking Press (2005)

It is the ecosystem, not the economy! Former President Bill Clinton may well have been on the mark in 1992 when he predicted that by focusing on the economy he could defeat then incumbent President George H.W. Bush in 1992, but in 2005 there is a growing sense of awareness that it is the natural environment that requires fixing. To be more precise, the ecosystems that comprise the natural resources upon which we depend for everything from food to energy are in a serious state of disrepair. Pulitzer Prize winning writer, Jared Diamond is at the forefront of acknowledged experts in diagnosing the source of the problem and prescribing solutions in a manner that is refreshing in that he avoids the rhetoric associated with partisan political debate on the topi... click here to learn more
